By accessing or using the website located at hammondmasonry.com (the "Site"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use the Site. These terms apply to all visitors and users of the Site, including individuals who submit estimate requests or other contact forms.
Hammond Masonry & Concrete is a masonry and concrete contractor based in Hammond, Indiana. Services offered include, but are not limited to, foundation repair, chimney repair, tuckpointing, brick repair, driveway pavers, retaining wall construction, masonry restoration, fireplace installation, stone veneer installation, concrete block walls, walkway construction, and related masonry and concrete work. All services are provided subject to a written agreement or accepted estimate.
Submitting a request through our website or by phone does not constitute a contract or commitment to perform work. An estimate is provided only after an in-person inspection of the project site by a qualified representative of Hammond Masonry & Concrete.
All estimates are provided in writing and are valid for 30 days from the date of issue unless otherwise stated. Pricing is based on conditions observed at the time of the site inspection. If conditions change or hidden issues are discovered during the course of work, Hammond Masonry & Concrete will notify you in writing before proceeding with any additional work that would affect the price.
Estimates do not include permit fees unless explicitly stated. Permit fees are the responsibility of the property owner and will be itemized separately when applicable.
Work is scheduled after a written estimate has been accepted and any required deposit has been received. Scheduling is subject to crew availability and weather conditions. Hammond Masonry & Concrete reserves the right to reschedule work due to weather or other circumstances outside our control, and will notify you as soon as practicable.
If you need to cancel or reschedule a job, please notify us at least 48 hours in advance. Cancellations made less than 48 hours before the scheduled start date may result in forfeiture of any deposit paid, depending on the materials already ordered or work already performed. Hammond Masonry & Concrete will communicate any applicable cancellation charges at the time of booking.
Payment terms are set out in the written estimate or service agreement for each project. In general, we require a deposit before work begins, with the remaining balance due upon completion of the work. Specific deposit amounts and payment schedules will be communicated in writing before work starts.
Accepted payment methods are specified in the estimate. If payment is not received by the due date, Hammond Masonry & Concrete reserves the right to suspend or discontinue work until payment is current. Overdue balances may be subject to applicable interest or collection costs as permitted under Indiana law.
Title to all materials installed remains with Hammond Masonry & Concrete until full payment is received.
Workmanship warranty terms, if any, are stated in the written service agreement for each project. Any warranty is limited to defects in workmanship and does not cover damage caused by events outside our control, including but not limited to subsequent ground movement, flooding, acts of nature, or work performed by others after our completion.
The Site and all information on it are provided "as is" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be error-free, uninterrupted, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, Hammond Masonry & Concrete shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, including loss of data, revenue, or profits, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from a project shall not exceed the total amount paid by you for that project.

Nothing in this section prevents either party from seeking emergency or injunctive relief from a court of competent jurisdiction where necessary.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. Any legal action arising under these terms shall be brought exclusively in the state or federal courts located in Indiana.
Hammond Masonry & Concrete reserves the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised terms. It is your responsibility to review these terms periodically.
